"On the legal status and honor the memory of fighters for independence of Ukraine in the twentieth century"
This law aims at recognizing participants in the struggle for the independence of Ukraine in the twentieth century the main actors struggle for the restoration of state independence of Ukraine - fighters for independence of Ukraine in the twentieth century, establishing the legal status of fighters for Ukraine's independence in the twentieth century, eligibility of public and municipal social guarantees given to fighters. Also, this law is aimed at recognition awards and degrees of military fighters for Ukraine's independence in the twentieth century, the definition of state policy to restore, preserve and commemorate the memory of this national struggle and establish responsibility for violation of the law on the status of fighters for Ukraine's independence in the twentieth century .
SECTION I
Legal status and honor the memory of fighters for independence of Ukraine in the twentieth century
Article 1. The legal status of independence fighters Ukraine
Fighters for independence of Ukraine in the XX century recognized individuals who took part in all forms of political, armed and other collective and individual struggle for the independence of Ukraine in the XX century as part of government, organizations, institutions and groups:
a) authorities Ukrainian People's Republic, including in particular the Ukrainian Central Rada and the General Secretariat of the Ukrainian Central Rada (Ukrainian People's Republic), the Council of Ministers of the People's Ukrainian People's Republic, the Government Ukrainian People's Republic in exile (Ukrainian State Centre of the People's Republic), General Secretary , ministry Resort Ukrainian People's Republic, including in exile diplomatic mission Ukrainian People's Republic abroad, local authorities Ukrainian National Republic, Ukrainian National Congress, Ukrainian Central Committee rebel (rebel Ukrainian Central Committee, VUTSPK, heavy) Labour Congress Ukraine (Congress Working People of Ukraine, Ukrainian Labour Congress) Directory of Ukrainian People's Republic, People's State Council, the Council of the Republic of the Ukrainian People's Republic, the Ukrainian National Council, President of the Ukrainian People's Republic in exile;
b) The authorities of the Ukrainian state (Hetmanate), including, in particular, the Council of Ministers of the Ukrainian State Minor Council of Ministers of the Ukrainian State, Ukrainian Ministry of State diplomatic missions and missions abroad Ukrainian State, local authorities Ukrainian State Hetman State Senate Ukrainian State General Court of the Ukrainian state;
c) The authorities West Ukrainian People's Republic (Western region of the Ukrainian People's Republic), including in particular the Western Ukrainian National Council of the People's Republic, the State Secretariat West Ukrainian People's Republic (Western region of the Ukrainian People's Republic), Secretariat (ministry) West Ukrainian People's Republic (Western Ukrainian region People's Republic), embassies, diplomatic missions and mission of the West Ukrainian National Republic (Western region of the Ukrainian People's Republic) abroad, the local authority West Ukrainian People's Republic (Western region of the Ukrainian People's Republic), President (dictator) West Ukrainian People's Republic (Western region of the Ukrainian People's Republic )
d) authorities East Lemko (Komanchanskoyi, Komanetskoyi) and the Hutsul Republic, including the council, Enlistment and Police Commissariat County Sanitskoho in Vyslotsi large, Hutsul People's Council;
e) authorities Carpathian Ukraine (Carpathian Ruthenia), including in particular Soim Carpathian Ukraine, Carpathian Ukraine government, ministries Carpathian Ukraine, local authorities Carpathian Ukraine, Carpathian Ukraine President;
d) military, security, and other military, paramilitary or paramilitary formation and of the Ukrainian People's Republic, the Ukrainian state (Hetmanate), West Ukrainian National Republic, East Lemko (Komanchanskoyi, Komanetskoyi) and the Hutsul Republic, Carpatho-Ukraine, including in particular the Ukrainian Sich Riflemen, effective Ukrainian People's Army, Galician Army (Ukrainian Galician Army) Povstancha army Ukraine, People's Defence Organization "Carpathian Sich";
g) political parties and other civil society organizations in the formation and during the existence of the Ukrainian People's Republic, the Ukrainian State West Ukrainian People's Republic (Western region of the Ukrainian People's Republic) Carpatho-Ukraine (Carpathian Ruthenia), the purpose of which was gaining (recovery) or protect the independence Ukraine;
e) insurgency, guerrilla groups that operated in Ukraine in 1917-1930 years and the aim of which was a struggle for obtaining, protection or restoration of independence of Ukraine, including units Kholodny, Medvynskoyi Republics, Volyn rebel (Povstancha) army;
g) Ukrainian Military Organization (UVO);
c) Organization of Ukrainian Nationalists (OUN);
a) People's Revolutionary Liberation Organisation (NVRO);
i) the Ukrainian Insurgent Army (UPA);
l) Povstancha Ukrainian army chieftain Taras Borovets (Bulba) "Woodland Sich" Ukrainian People's Revolutionary Army (UNRA);
and) Ukrainian Supreme Liberation Council (UHVR), including External Representation Ukrainian Supreme Liberation Council (CL UHVR);
C) Anti-Bolshevik Bloc of Nations (ABN);
l) Ukrainian Helsinki (Group) (GHS, UGG);
m) of the Ukrainian liberation movement in the second half of the twentieth century, including in particular the group "Our change" organization "breakdown" Basil Buchkovska group, the group "United Liberation Party of Ukraine" (OPVU), organization of "detachment of young rebels" ( ZYUP), a group of Bohdan Stefaniuk, underground organization "Association" (1956-1959 years), Ukrainian National Committee, Ukrainian worker-peasant alliance (Hodorivska group), Ukrainian National Party, Ukrainian Worker-Peasant Union (URSS), Ukrainian National front Ukrainian national liberation front, Ukrainian Youth Association of Galicia, Stebnykivsku group Rosohatsku group Ukrainian nationwide organization (UZNO, UNF-2);
n) organization formed by individuals who have suffered political persecution for their participation in the struggle for the independence of Ukraine in the twentieth century, the Soviet prison camps or camp offices to fight for their civil or other rights;
e) People's Movement of Ukraine for Perestroika (People's Movement of Ukraine) 24 August 1991;
c) other organization, structure or formation that existed during the XX century (24 August 1991), and the purpose of which was gaining (recovery) or protect the independence of Ukraine. The list of such organizations, structures and units approved by the Cabinet of Ministers of Ukraine.
Article 2. Principles of the legal status of independence fighters Ukraine
1. States Parties agree that the fighters for independence of Ukraine in the twentieth century, as defined in Article 1 of this Act, have played a major role in the restoration of Ukrainian statehood, declared the Act of August 24, 1991, which is the main prerequisite for granting legal status and commemoration fighters for Ukraine's independence in the twentieth century.
2. The legal basis for granting legal status to fighters for independence of Ukraine in the twentieth century is the international instruments and national legislation of Ukraine, in accordance with which the government considers lawful forms and methods of struggle for the independence of Ukraine in the twentieth century.
Article 3. The social protection of fighters for Ukraine's independence in the twentieth century and their families
1. The state may provide social guarantees, benefits or other payments fighters for independence of Ukraine in the twentieth century and their families.
2. Local authorities may, at the expense of local budgets to provide additional social guarantees, benefits or other payments fighters for Ukraine's independence in the twentieth century and their families.
Article 4. Recognition awards and degrees of military fighters for Ukraine's independence in the twentieth century
State recognized civil and military awards (honors) degree and military fighters for Ukraine's independence in the twentieth century that were provided to the participants of the fight authorities, organizations, agencies or units referred to in Article 1 hereof.
Article 5. State policy to restore, preserve and commemorate the memory of the national struggle for independence of Ukraine in the twentieth century and its fighters
1. The state provides a comprehensive study of the history of the struggle for the independence of Ukraine in the twentieth century and its fighters.
2. States shall take measures aimed at increasing awareness and public attention to the history of society and the struggle for the independence of Ukraine in the twentieth century and its fighters, develops and improves textbooks, programs and activities on the history of the struggle for the independence of Ukraine in the twentieth century and its fighters, disseminates objective information in Ukraine and the world about the struggle for the independence of Ukraine in the twentieth century and its fighters.
3. The state encourages and supports the activities of NGOs and organizations that research and raising public awareness about the struggle for the independence of Ukraine in the twentieth century and its fighters.
4. The state helps perpetuate the memory of the fighters for independence of Ukraine by, searching, recording, organizing and preserving their burial places both in Ukraine and abroad, the formation of new graves and memorial complexes, construction and restoration of monuments Monument, monuments, perpetuate the names or aliases fighters and units referred to in Article 1 of this Act, in the names of objects toponymy settlements or administrative units, names of geographic features, production print, film and video activity on stage and other artistic embodiment of images of fighters for Ukraine's independence in the twentieth century.
Article 6. Responsibility for violation of legislation on the status of fighters for Ukraine's independence in the twentieth century
1. Citizens of Ukraine, foreigners and stateless persons who publicly showing contempt for the persons referred to in Article 1 of this Act, the rights prevent fighters for independence of Ukraine in the XX century liable in accordance with the laws of Ukraine.
2. Public denial of the legitimacy of the struggle for the independence of Ukraine in the twentieth century recognized insult to the memory of fighters for independence of Ukraine in the XX century disparagement of the Ukrainian people and is unlawful.
SECTION II.
Final Provisions
1. This Act shall take effect from the day following the day of its publication.
